Terms of Use.
Draft prepared for professional legal review. Not yet in force.
Last updated: 2026-07-02 (draft)
1. Who we are and what you are agreeing to
Trancr is operated by [Operator legal name] ("Trancr," "we," "us"), based in Alberta, Canada.
These Terms of Use, together with our
Privacy Policy,
form a binding agreement between you and us governing your use of the Trancr website and
progressive web application (the "Service"). By creating an account or using the Service you
accept these Terms. If you do not accept them, do not use the Service.
2. What Trancr is, and what it is not
Trancr is a matching and community platform for people interested in recreational,
relaxation-oriented, and practice-oriented hypnosis. It connects hypnotists, subjects,
switches, and learners for in-person and online sessions and meetups.
Trancr is not a medical, psychological, or therapeutic service.
Nothing on the Service is medical advice, mental-health treatment, or a substitute for care
from a qualified health professional. Members who identify as hypnotherapists or practitioners
use the Service in a personal, non-clinical capacity and must acknowledge that they are not
offering clinical treatment through the Service. If you are in distress or have a medical or
mental-health concern, seek help from a qualified professional. Resources are listed on our
Wellbeing page.
3. Eligibility: 18 years or older
You must be at least 18 years of age to use the Service. Age is confirmed by your attestation
at registration; we do not collect identity documents, and we rely on your honesty backed by
moderation. Attesting falsely is a material breach of these Terms and grounds for immediate
and permanent removal. Any involvement of minors in trance work is categorically prohibited
and will be reported to authorities where the law requires or permits.
4. Your account, your recovery key
Accounts are pseudonymous: a username and password only. We never collect your email address
or legal name, so there is no email-based password reset. At registration you are issued a
one-time recovery key and backup codes. These are shown once and stored on
our side only as cryptographic hashes.
If you lose your password and your recovery key, your account cannot be recovered by
anyone, including us. This is a deliberate privacy design, and you accept this
limitation by using the Service. You are responsible for storing your recovery key safely,
for safeguarding your credentials, and for all activity under your account. You may
regenerate your recovery key at any time from within a signed-in session, which invalidates
the previous key.
You may also sign in through a third-party provider (such as Google, Microsoft, Facebook,
X/Twitter, or Bluesky). We use these providers for sign-in only; any email address they offer
us is discarded, and the same recovery-key rules apply.
5. The SFW covenant
Trancr is strictly SFW ("safe for work"): recreational and relaxation-oriented hypnosis only,
never erotic or sexual. You accept this covenant (currently version 1.0) at registration, and
it applies to everything you do on the Service: your profile, images, tags, messages, audio,
scripts, and conduct in sessions arranged through the Service. Repeated or flagrant NSFW
solicitation is fast-tracked to a permanent ban.
6. Consent norms and community rules
Consent is the foundation of this community. By using the Service you agree that:
- A stop signal or wake word is honoured immediately and without argument, every time.
- Either party may end a session at any moment, for any reason.
- Pre-session consent agreements made through the Service reflect the limits both parties
have agreed to, and you will respect them.
- You will not record another person in any form without their explicit prior consent,
and you are solely responsible for complying with the recording and privacy laws that
apply where you and the other party are located.
- Another member's declared hard limits and boundaries are not topics for negotiation or
pressure.
In addition, you must not:
- post or solicit sexual or NSFW content, or use the Service to arrange NSFW activity;
- harass, threaten, stalk, or intimidate any member;
- pressure a new contact to move immediately to private off-platform channels;
- misrepresent your identity, age, experience, or credentials;
- use the Service for commercial solicitation, advertising, or recruiting without our
written permission;
- scrape, harvest, or systematically collect member data, or attempt to deanonymize any
member;
- attempt to probe, disrupt, or gain unauthorized access to the Service or other members'
accounts; or
- use the Service for any unlawful purpose.
7. Safety: no vetting, your judgment required
We do not verify the identity, background, or claims of any member, and we do not
conduct criminal-record or other background checks. Vouches, reputation signals, and
moderation are community aids, not guarantees of anyone's character or competence. You are
solely responsible for your interactions with other members, online and in person.
For in-person meetings we strongly encourage the practices built into the Service: meet first
in public places, use the pre-session consent agreement, share your plans with a trusted
contact, and use the check-in timer. These features are conveniences to support your own
precautions; they do not summon help and are not a safety guarantee. Hypnosis involves one
person guiding another into a suggestible state; you accept the inherent risks of that
activity and of meeting people you first encountered online.
8. Your content
You keep ownership of the content you post (profile text, images, messages, audio, scripts).
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce,
display, and transmit that content as needed to operate, moderate, and improve the Service.
This licence ends when your content is deleted, except as described below and in the Privacy
Policy.
You are responsible for what you post. Post only content you have the right to share, and
only persona images and artwork rather than photographs of real people. Uploaded images are
automatically re-encoded and stripped of metadata, and may be screened by automated
moderation tools before acceptance.
Content that has been reported is preserved for moderation review even if the reporter or the
reported member unmatches or deletes it, and records of consent agreements and moderation
actions are retained as described in the Privacy Policy.
9. Moderation and enforcement
We use a combination of member reports, automated screening, and human moderators.
Enforcement is tiered: warning, temporary suspension, then permanent ban, although we may
skip tiers for serious violations (including NSFW solicitation, violations involving minors,
failure to honour a stop signal, and threats or violence). Automated flags are reviewed by
humans and never result in an automatic ban. If you believe an enforcement action was made
in error, you may appeal through the
contact page;
we will review appeals in good faith, but our decision after review is final.
10. Third-party platforms
Members may arrange to continue conversations or sessions on third-party platforms such as
Discord, Telegram, VR platforms, or Bluesky. Those platforms are not part of the Service.
We do not control them, their terms and privacy policies govern your use of them, and our
moderation cannot reach conduct that happens there. Take particular care before moving a new
contact off-platform.
11. Fees
The Service is currently free. We may introduce optional paid features in the future; if we
do, pricing and payment terms will be presented before you are charged, and no existing
safety or consent feature will be moved behind a paywall.
12. Our intellectual property
The Service, including its software, design, text, and branding, is owned by us or our
licensors and is protected by Canadian and international intellectual-property law. We grant
you a personal, non-exclusive, non-transferable, revocable licence to use the Service in
accordance with these Terms. You may not copy, modify, distribute, or create derivative works
from the Service except as the law permits notwithstanding this restriction.
13. Privacy
Our collection, use, and disclosure of personal information is governed by our
Privacy Policy,
which forms part of these Terms and complies with Alberta's Personal Information Protection
Act (PIPA).
14. Disclaimers
The Service is provided "as is" and "as available." To the extent permitted by applicable
law, we make no warranties or conditions of any kind, express or implied, including fitness
for a particular purpose, merchantable quality, non-infringement, availability, or that the
Service will be uninterrupted, error-free, or secure. We make no representation about the
conduct, identity, or compatibility of any member, or about the outcome of any session or
meeting arranged through the Service.
15. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for indirect,
incidental, special, consequential, exemplary, or punitive damages, or for loss of data,
goodwill, or opportunity, arising out of or relating to the Service, including the conduct of
any member online or in person, or the permanent loss of access to an account whose recovery
key was lost. To the same extent, our total aggregate liability for all claims relating to
the Service will not exceed the greater of CAD $100 and the amounts you paid us in the twelve
months before the event giving rise to the claim.
Some jurisdictions, including Alberta in respect of certain consumer rights, do not allow the
exclusion or limitation of particular warranties, conditions, or liabilities. Nothing in
these Terms excludes, restricts, or modifies any right or remedy you have under applicable
law that cannot lawfully be excluded, restricted, or modified, including under the Alberta
Consumer Protection Act.
16. Indemnity
To the extent permitted by applicable law, you agree to indemnify us against claims, damages,
and reasonable costs (including legal fees) brought by a third party arising out of your
content, your conduct toward other members, or your breach of these Terms, except to the
extent caused by our own negligence or wilful misconduct.
17. Suspension and termination
You may stop using the Service and request deletion of your account at any time. We may
suspend or terminate your access at any time for breach of these Terms, to protect members,
or if the Service is discontinued. On termination, sections that by their nature should
survive (including sections 8, 14, 15, 16, and 19) survive. Data handling after account
deletion is described in the Privacy Policy.
18. Changes to these Terms
We may update these Terms from time to time. For material changes we will give notice within
the Service before the changes take effect, and the "last updated" date above will change.
Your continued use of the Service after the effective date constitutes acceptance. If you do
not accept updated Terms, stop using the Service and request account deletion.
19. Governing law and disputes
These Terms are governed by the laws of the Province of Alberta and the federal laws of
Canada applicable in Alberta, without regard to conflict-of-laws rules. You and we submit to
the exclusive jurisdiction of the courts of Alberta for any dispute arising out of these
Terms or the Service, except that either party may seek relief in a court of competent
jurisdiction where required, and nothing in this section deprives you of the protection of
mandatory consumer-protection provisions of the jurisdiction where you reside.
20. General
If any provision of these Terms is held unenforceable, the remainder stays in effect and the
provision will be enforced to the maximum extent permitted. Our failure to enforce a
provision is not a waiver of it. You may not assign these Terms; we may assign them in
connection with a reorganization or transfer of the Service, subject to the Privacy Policy.
These Terms and the Privacy Policy are the entire agreement between you and us regarding the
Service.
21. Contact
Questions about these Terms should be directed to us through
the contact page.
